Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and ForQ Inc. (“ForQ,” “we,” “us,” or “our”) governing your access to and use of the website at noderhq.com, the ForQ applications, and any related services (collectively, the “Services”).

By accessing or using the Services, including by signing in with Google or joining our waitlist, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old (or at least 16 in the European Economic Area and the United Kingdom) to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian who agrees to these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts and Google sign-in

You may create an account by signing in with your Google account. By doing so, you authorize us to access the basic profile information described in our Privacy Policy. Your use of Google sign-in is also subject to Google’s own terms and privacy policy.

You are responsible for maintaining the security of your Google account and for all activity that occurs under your ForQ account. Notify us immediately at hello@noderhq.com if you suspect unauthorized use. You agree to provide accurate information and to keep it up to date.

3. Waitlist, beta, and pre-release features

Joining the waitlist does not guarantee access to the Services. Some features may be offered as beta, preview, or TestFlight releases. These features are provided for evaluation, may contain bugs, may change or be discontinued at any time, and are provided “as is” without any commitment of availability or support.

4. Your content

The Services may allow you to create, upload, share, or publish roadmaps, resources, comments, and other materials (“User Content”). You retain ownership of your User Content.

By submitting User Content, you grant ForQ a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting purposes), display, and distribute your User Content solely to operate, provide, promote, and improve the Services. This license ends when you delete your User Content or account, except for content that has been shared with others and that they have not deleted, and copies retained as required by law or in routine backups.

You represent that you own or have the necessary rights to your User Content and that it does not infringe or violate the rights of any third party or any applicable law.

5. Acceptable use

You agree not to:

• Violate any applicable law or regulation, or the rights of others;
• Post content that is unlawful, harassing, hateful, defamatory, obscene, or misleading;
• Infringe any intellectual property, privacy, or publicity rights;
• Impersonate any person or entity, or misrepresent your affiliation with them;
• Upload viruses, malware, or any other harmful code;
• Attempt to gain unauthorized access to the Services, other accounts, or our systems;
• Interfere with or disrupt the integrity or performance of the Services;
• Scrape, crawl, or collect data from the Services by automated means without our written permission;
• Reverse engineer, decompile, or disassemble any part of the Services, except as permitted by law;
• Send spam or unsolicited commercial communications;
• Use the Services to build a competing product or service.

We may, but are not obligated to, review, remove, or restrict any User Content or account that we believe violates these Terms.

6. Our intellectual property

The Services, including their software, design, text, graphics, logos, and the ForQ name and trademarks, are owned by ForQ or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use. All rights not expressly granted are reserved.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation to you.

7. Copyright complaints

We respect intellectual property rights. If you believe content on the Services infringes your copyright, send a notice to hello@noderhq.com including: identification of the copyrighted work; identification of the allegedly infringing material and its location; your contact information; a statement that you have a good-faith belief the use is unauthorized; a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the owner’s behalf; and your physical or electronic signature. We may terminate the accounts of repeat infringers.

8. Third-party services and links

The Services may integrate with or link to third-party services, including Google, and to learning resources hosted by others. We do not control and are not responsible for third-party services or content, and your use of them is governed by their own terms.

9. Suspension and termination

You may stop using the Services and request deletion of your account at any time by contacting us. We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Services. Sections that by their nature should survive termination (including User Content licenses already exercised, disclaimers, limitations of liability, indemnification, and dispute terms) will survive.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any content, including learning resources and roadmaps provided by users, is accurate, complete, or reliable.

Content on the Services is for general educational purposes only and does not constitute professional advice.

11. Limitation of liability

To the maximum extent permitted by law, ForQ and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless ForQ and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your User Content, your use of the Services, or your violation of these Terms or the rights of any third party.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which ForQ Inc. is incorporated, without regard to its conflict-of-law principles. Before filing any claim, you agree to try to resolve the dispute informally by contacting us at hello@noderhq.com; we will try to resolve it within 60 days. Any dispute not resolved informally will be brought exclusively in the courts located in that jurisdiction, and you and ForQ consent to their personal jurisdiction. Nothing in this section limits any rights you may have under mandatory consumer protection laws of your country of residence.

14. Changes to these Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by email or through the Services before they take effect. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.

15. General

These Terms, together with our Privacy Policy, are the entire agreement between you and ForQ regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries to these Terms.
